I agree with your saying, but not all emails can be considered spam, at least in my opinion. I had a situation when the owner of a certain email address was accepting my news / sales letters and after that he was reporting them as being spam and he become a bit "violent" in his emails.
The reality is that we don't decide what spam is...the recipient does. If they think it's spam and tag it as such, then it is. I certainly never suggested all email is spam.
Email in and of itself is not spam. What is spam is how you communicate/market via email. If you follow the law and best pracitices and you nuture the relationships with your subscribers, you should have pretty clear sailing.
Having said that, people do forget or change their minds and even if it seems unreasonable, they will press that spam button. You can't prevent that, you can only do your best to manage the risk.
