Hello,
It is not easy to get more and more successful in E-Mail Marketing. One needs to take care of several things.

-Get permission. Don’t buy or rent lists of email addresses. Include simple unsubscribe instructions, then abide by users’ wishes if they opt-out.
-Work at your subject line. It should have a good call to action or value proposition. Use the subject line to satisfy the recipients’ needs and appeal to their interests. Consider including their first name.
-Make it easy: easy to unsubscribe, to offer feedback or to place an order by phone, email or online. Make sure if recipients hit “Reply”, it doesn’t come straight back to them marked “Undeliverable”.
-Distance yourself from spammers, weasels selling weight loss and Nigerian scam merchants. Put your name or your company’s name in the ‘From’ line, not ‘Here it is’ or ‘jm169@hotmail.com’. Sign your email with a real person’s name. ----Address it to the person you want to receive it, not to ‘undisclosed recipients’.

Provided that the subscribers have opted in, preferably double opt in, then as long as you are delivering what you promised then you have nothing to worry about. It is certainly not spam. However, broadcast systems are not bullet proof. I have often had a subscriber report me for spam simply because many do not know the difference between unsubscibe and report as spam. These show up in your account as spam even if the subsciber has double opted in and you have been sending exactly as promised. I think you shouldn't look too deep into these things that are out of your control.

It can be spam if you send out junk, it's really not spam if you send out value to your list if you send out junk you'll find half of your subscribers leaving your list.
